McGilloway covers proven IDV under the 2008 policy
In McGilloway v. Safety Insurance Co., 488 Mass. 610 (2021), the Supreme Judicial Court interpreted Part 4 of the 2008 standard policy to cover third-party inherent diminished value. The claimant must establish both that the vehicle remains worth less after complete repairs and the amount of that loss. The decision did not prescribe a valuation formula or make every repaired vehicle eligible for a standard percentage.
Cubberley changes the insurer-coverage answer for the 2016 policy
Cubberley v. Commerce Insurance Co., 249 N.E.3d 1129 (Mass. 2025) holds that Part 4 of the 2016 standard policy excludes decreased value or intangible loss and that McGilloway does not override that newer language. The court distinguished the insurer's contractual obligation from the damages the at-fault person may owe in tort. It also held that the plaintiffs lacked standing to sue the insurer directly before satisfying the statutory judgment prerequisite.
The current Division of Insurance auto-claims FAQ reflects this split and notes that insurers may use the 2008 or 2016 standard form or an approved proprietary form. Ask the liability insurer to identify the exact form and relevant Part 4 language.
Given limits first-party collision claims
In Given v. Commerce Insurance Co., 440 Mass. 207 (2003), the SJC held that the Part 7 collision language before it did not require the owner's insurer to pay inherent diminished value after satisfactory repairs. Given is a coverage decision, not permission for an insurer to leave physical repairs incomplete or unsafe. Review the actual policy and repair record.
The general Massachusetts tort period is three years
Mass. General Laws chapter 260, section 2A generally requires tort actions to be commenced within three years after accrual. Policy notice, a public defendant, a contract theory, a release, or unusual accrual facts can involve different or earlier requirements. The limitations period does not preserve changing listings, dealer opinions, or repair evidence.
Comparative negligence can reduce or bar recovery
Mass. General Laws chapter 231, section 85 permits recovery when the claimant's negligence is not greater than the combined negligence of the defendants, with damages reduced by the claimant's percentage. That supports only the practical value of verifiable history and condition evidence; it does not prove a Massachusetts payout percentage. Formula 17c is not the Massachusetts rule
