Can you recover diminished value in Indiana?
Yes. Indiana recognizes a proven loss in fair market value that remains after successful repairs. The claimant must connect the accident to an actual reduction in this vehicle's value. Repair cost alone is adequate only when the repair restores the vehicle to its pre-accident fair market value.
Indiana claim paths
| Claim path | Starting point | What controls |
|---|---|---|
| Third-party liability | Shield Global recognizes adequately proved residual loss. | Fault, repairs, causation, fair market value, and available limits. |
| Own collision coverage | Allgood enforced the repair-or-replace limit reviewed. | Policy language, repair adequacy, exclusions, deductible, and appraisal terms. |
| Uninsured motorist property damage | May use a legal-entitlement measure under the policy. | Applicable state law, selected coverage, wording, limits, and no duplicate payment. |
Shield Global recognizes post-repair market loss
In Shield Global Partners-G1, LLC v. Forster, 141 N.E.3d 1269 (Ind. Ct. App. 2020), the Court of Appeals rejected the view that successful repair automatically defeats diminished value. Indiana permits the reduction in fair market value to be proved by before-and-after values, repair cost when repair restores value, or repair cost plus the remaining difference between pre-loss and post-repair value when it does not.
The accepted proof included maintenance records, mileage, repair estimates, vehicle-history reports, and photographs. The court said a personal inspection was not required on that record; it did not hold that every remote appraisal is sufficient or award a fixed percentage to every repaired vehicle.
Allgood limits the collision policy it reviewed
Allgood v. Meridian Security Insurance Co., 836 N.E.2d 243 (Ind. 2005) holds that collision coverage limited to the lesser of actual cash value or the amount necessary to repair or replace with like kind and quality did not require a separate diminished-value payment after adequate repairs. That policy rule does not change the tort measure in Shield Global or excuse inadequate physical repairs.
Uninsured-motorist coverage requires a separate policy analysis
In Dunn v. Meridian Mutual Insurance Co., 836 N.E.2d 249 (Ind. 2005), legal-entitlement wording allowed recovery of the uninsured tortfeasor's diminished-value liability, subject to limits and no duplicate payment. Dunn involved a Tennessee resident and applied Tennessee law to the policy, so it is not a blanket Indiana-coverage rule. Confirm the applicable law, selected property-damage coverage, wording, limits, and deductible.
Indiana generally uses a two-year property-damage period
Indiana Code section 34-11-2-4 generally requires an action for injury to personal property to be commenced within two years after accrual. Policy notice, governmental defendants, contract claims, releases, and unusual accrual facts can create different or earlier requirements.
Comparative fault can reduce or bar recovery
Indiana's Comparative Fault Act, including section 34-51-2-6, generally reduces damages by the claimant's fault and bars recovery when claimant fault is greater than 50%. The chapter excludes governmental entities and public employees, where different rules and notice requirements can apply. Preserve the crash report, photographs, video, witnesses, citations, and vehicle data.
Use the Indiana market where the vehicle would sell
Indianapolis and central Indiana inventory may not track northwest Indiana near Chicago, Fort Wayne and northeast Indiana, the South Bend corridor, the Evansville market, or rural southern Indiana. Match year, trim, drivetrain, mileage, options, condition, title status, prior history, and valuation date. Adjust for truck, EV, luxury, winter-use, and regional supply differences only when the evidence supports the adjustment.
Peer-reviewed used-car research found that credible vehicle information can change how market participants use disclosed facts in pricing. That supports only the practical value of verifiable history and condition evidence; it does not establish an Indiana payout percentage. See Cho, Frankel, and Martin, Information Reliability and Market Outcomes.
Formula 17c is not required in Indiana
None of the Indiana authorities cited here mandates Formula 17c or a 10% starting cap. Use the 17c formula guide as a rough worksheet, then test its inputs against the fair-market-value proof described in Shield Global.
Evidence for an Indiana diminished value demand
- the crash report, fault decision, claim number, witnesses, and dated photographs;
- the final invoice, supplements, parts list, measurements, scans, and calibrations;
- pre-loss mileage, condition, options, service records, title status, and prior-history report;
- a post-repair appraisal explaining both values, the date, method, sources, and adjustments;
- local clean-history and accident-history comparisons and reliably documented dealer bids; and
- the policy when relevant, insurer worksheets, offers, payments, denial reasons, and release.
How to file an Indiana diminished value claim
- Confirm fault, ownership, available coverage, and that safe repairs are complete.
- Preserve the repair file and allow any inspection required before permanent repairs.
- Use the diminished value calculator for a starting estimate, then replace generic assumptions with Indiana market evidence.
- Send a dated demand identifying the vehicle, loss date, claim number, amount, method, and exhibits. The claim letter template can serve as an outline.
- Ask for an itemized valuation and the factual, legal, or policy basis for any reduction or denial.
- Do not sign a broad property-damage release until every claimed vehicle loss is resolved.
Indiana Department of Insurance complaint help
IDOI's claim tips recommend prompt notice, complete records, a written denial with the specific policy language, and an itemized settlement explanation. If a documented handling issue remains after contacting the company, use the IDOI complaint process. The Department can review compliance and take administrative action, but it cannot act as a court, compel payment, determine claim value, provide private legal advice, or extend a filing deadline.

Calculate My Diminished ValueIndiana diminished value FAQ
Can I file a diminished value claim in Indiana?
Yes. Shield Global Partners-G1 v. Forster recognizes that a vehicle may remain worth less after successful repairs. The claimant must prove the reduction in fair market value caused by the collision with competent, vehicle-specific evidence.
How does Indiana measure post-repair diminished value?
Indiana permits proof through pre- and post-loss values, repair cost when repair restores value, or repair cost plus the remaining difference between pre-loss and post-repair value when repair does not fully restore market value. The evidence must avoid duplicate recovery.
Does my own Indiana collision policy cover diminished value?
Not automatically. Allgood v. Meridian holds that the actual-cash-value or repair-or-replace limit before the court did not require a separate diminished-value payment after adequate repairs. Different language, inadequate repairs, or another coverage part requires separate review.
How long do I have to file an Indiana diminished value claim?
Indiana Code section 34-11-2-4 generally provides two years for an action involving injury to personal property. Policy notice, government claims, contract theories, and unusual accrual facts can create different or earlier requirements.
Can partial fault reduce an Indiana diminished value claim?
Yes. Indiana’s Comparative Fault Act generally reduces damages by the claimant’s fault and bars recovery when claimant fault is greater than 50%. Claims against governmental entities are excluded from that chapter and can follow different rules.
Is Formula 17c required in Indiana?
No Indiana authority cited on this page requires Formula 17c. Shield Global applies fair market value and accepted an appraisal based on vehicle records, mileage, repair information, history reports, and photographs rather than a mandatory generic formula.
